When planning to expand your employee base in Mexico, you should first have an in-depth knowledge of the employment landscape. This will be your number one priority. Here are the things to consider:

  • Employment Contracts and Compliance: In Mexico, employment contracts are governed by the Federal Labor Law (Ley Federal del Trabajo) and must be written in Spanish. The indefinite-term contract is the default form of employment, and the law sets out detailed rules covering how these agreements are drafted, executed, and terminated.

  • Mandatory Benefits: Employers must provide the aguinaldo, a Christmas bonus equal to at least 15 days' salary paid by December 20, as well as statutory profit sharing (PTU) and a vacation premium (prima vacacional) of at least 25%. Since 2023, employees are entitled to a minimum of 12 vacation days in their first year.

  • Work Hours and Social Security/Tax: The standard workweek can run up to 48 hours. Employers register their staff with IMSS for social security and healthcare, and contribute to INFONAVIT (the national housing fund) and the SAR/Afore retirement savings system.
