Contract Types Explored

In Hong Kong, employment contracts can be oral or written and either continuous or fixed-term. A written contract is strongly recommended, and once an employee works under a "continuous contract"--generally four or more weeks with an aggregate of at least 68 working hours (the "468 rule" in force since 18 January 2026)--they gain the full protections and benefits of the Employment Ordinance.

Probationary Period Practices

Probation is common and typically runs three months. During the first month either party may terminate without notice; after the first month, at least seven days' notice (or payment in lieu) applies during the remaining probation period.

Payroll & Taxes

Monthly Salary Disbursement

Salaries in Hong Kong are typically paid monthly in Hong Kong Dollars. Unlike many jurisdictions, employers do not withhold Salaries Tax from pay; instead they report remuneration to the Inland Revenue Department on the IR56 forms and employees settle their own tax assessments.

Government Contributions

Employers and employees each contribute 5% of relevant income to a Mandatory Provident Fund (MPF) scheme, subject to a HK$7,100 minimum and HK$30,000 maximum monthly relevant-income level (so the employer's mandatory contribution is capped at HK$1,500 per month). Employees aged 18-64 must be enrolled once employed for 60 days or more.

Employee Benefits & Rights

Working Hours and Holidays

Hong Kong sets no statutory maximum on working hours, so these are agreed in the contract. Employees on a continuous contract are entitled to at least one rest day every seven days plus the statutory holidays (14 in 2025, rising to 15 from 2026).

Annual Leaves

After 12 months of continuous service, employees are entitled to paid annual leave starting at 7 days and increasing by one day per additional year of service up to a maximum of 14 days.

Special Leaves

Hong Kong provides several statutory leaves, including 14 weeks of maternity leave for eligible employees and 5 days of paternity leave, both paid at four-fifths of average daily wages for employees who meet the service conditions.

Medical Leaves

Employees accumulate paid sickness days--2 per month in the first year of service and 4 per month thereafter, up to 120 days. Sickness allowance is paid at four-fifths of average daily wages for sick leave of four or more consecutive days supported by a medical certificate.

Termination

Written Notice Requirement

Either party may end a continuous contract by giving the agreed notice, or the statutory default of one month where the contract is silent, except in cases of summary dismissal for serious misconduct. Payment in lieu of notice is permitted.

Severance & Long Service Pay

Employees dismissed by redundancy after 24 months qualify for a severance payment, while those with 5+ years leaving in other qualifying circumstances receive a long service payment (never both). Each is calculated as two-thirds of the last month's wages per year of service, capped at HK$390,000. Since 1 May 2025 employers can no longer offset these against MPF contributions.
