In Malaysia, employment contracts can be indefinite term (permanent) or fixed-term. Permanent contracts offer stability with no set end date, while fixed-term contracts are for specific durations, often project-based or temporary positions.

The typical workweek in Malaysia is capped at 8 hours per day or 45 hours per week. Employees are entitled to 11 public holidays annually, and work on these holidays must be compensated at twice the standard hourly rate.
Annual Leaves
In Malaysia, employees earn annual leave based on their length of service. Those with less than 2 years receive 8 days, 2 to 5 years receive 12 days, and over 5 years are entitled to 16 days.
Special Leaves
Maternity leave offers 98 days of paid leave. Paternity and compassionate leave may also be available, depending on company policies.
Medical Leaves
Sick leave also depends on tenure: 14 days for under 2 years, 18 days for 2 to 5 years, and 22 days for over 5 years. Additionally, all employees get 60 days of hospitalization leave annually.
Termination
Written Notice Requirement
Termination must be accompanied by a written notice stating the reason for dismissal. Employees must be given the opportunity to respond to any allegations, ensuring a fair and transparent process.
Severance Pay Clarification
Severance pay in Malaysia is calculated based on years of service. Employees with less than 2 years of service are entitled to 10 days’ salary for each year of service. Those who have worked between 2 and 5 years receive 15 days’ salary per year of service, and employees with more than 5 years of service are awarded 20 days' salary for every year completed.
