Hiring & Contract
Contract Types Explored
In the Philippines, contracts can either be indefinite or definite term. Indefinite term contracts are typically for long-term employment, while definite term contracts are for temporary or project-based work, with a specified end date.
Probationary Period Practices
Employers in the Philippines can place employees on a probationary period of up to six months. During this period, both employer and employee can assess suitability for long-term employment.
Payroll & Taxes
Monthly Salary Disbursement
Salaries are paid every two weeks, ensuring employees receive payment at intervals of no more than 16 days. The minimum wage varies by region, with Metro Manila setting a daily minimum wage of 11 USD for non-agriculture workers.
Government Contributions
Employers are required to contribute to the Social Security System (SSS), PhilHealth for healthcare coverage, and Pag-IBIG for housing and savings benefits. These contributions provide vital social security for employees.
Employee Benefits & Rights
Working Hours and Holidays
Employees work 8 hours a day, with a maximum of 40 hours a week. They are entitled to 10 paid public holidays. For work done on regular holidays, employees receive double pay, and special non-working holidays entitle employees to 130% of their regular pay.
Annual Leaves
Employees are entitled to a minimum of 5 days of annual leave per year, with additional leave often provided based on company policy or length of service.
Special Leaves
Employees have access to various special leaves, including maternity, paternity, and parental leave, as well as compassionate leave for personal emergencies.
Medical Leaves
Although not mandated beyond the 5 days of Service Incentive Leave (SIL), most companies provide regular employees with 12 to 15 days of paid sick leave once they have been regularized.
Termination
Written Notice Requirement
When terminating an employee for just cause, employers must provide a written notice, allowing at least 5 days for the employee to respond. A final notice must be given 30 days before the termination date.
Severance Pay Clarification
In cases of redundancy or business closure, employees are entitled to separation pay. This is typically calculated as half a month's pay per year of service for retrenchment or business closure, and one month's pay per year of service for redundancy or labor-saving device installations.
