Payroll in India
Payroll Cycle
Salary is generally paid near month end. The statutory deadline depends on the applicable wage law and establishment size.
Minimum Wage
Minimum wages vary by state, scheduled employment, occupation, and skill category. Employers must use the rate applicable to the employee’s location and role.
Overtime Pay
- Common statutory limits are 9 hours per day and 48 hours per week, but the applicable rule depends on the state Shops and Establishments law, the Factories Act or sector-specific law. - Daily, quarterly and annual overtime caps vary by state and industry. Use the employee’s work state and establishment type.
- Covered factory or state-law overtime: Ordinary Hourly Rate × 2.00 × Overtime Hours. - Confirm the employee’s state and governing statute.
Bonus
13th Month
India does not require a universal 13th month salary. Covered establishments must pay an annual statutory bonus under the Payment of Bonus Act to eligible employees.
Minimum statutory bonus = 8.33% of salary or wages earned in the accounting year. Maximum = 20%. For calculation, salary or wages are capped at INR 7,000 per month or the applicable minimum wage for the scheduled employment, whichever is higher.
The central Act generally covers factories and establishments employing at least 20 persons. An employee earning up to INR 21,000 per month who worked at least 30 working days in the accounting year is eligible, subject to statutory disqualification rules. The amount is linked to allocable surplus but cannot fall below the statutory minimum. Payment is normally due within 8 months after the close of the accounting year. Employees outside the Act receive an annual or festival bonus only if their contract, collective agreement, or employer policy provides one.
